The Statutory Hierarchy of GST Appeals in Gujarat
Understanding how tax orders progress from original adjudication to the final fact-finding Tribunal.
Original Adjudication
Section 73 / 74 Order (DRC-07): Order passed by Assistant/Deputy Commissioner or Superintendent confirming tax demand, interest under Section 50, and penalty.
First Appellate Authority
Section 107 Appeal (APL-01): Appeal before Commissioner (Appeals) within 3 months. Mandatory 10% pre-deposit of disputed tax amount grants stay on 90% demand.
GSTAT Second Appeal
Section 112 Appeal (APL-05): Appeal before the Goods and Services Tax Appellate Tribunal Bench against adverse Section 107 orders. Additional 20% pre-deposit.
Automatic Recovery Stay
Section 112(9) Protection: On depositing the 20% pre-deposit, recovery proceedings for the remaining 70% disputed tax stand stayed by statutory command.
Hearing on Fact & Law
Two-Member Bench: Comprehensive arguments presented before a Judicial Member and a Technical Member covering statutory interpretation and accounting reconciliation.
Finality of Facts
High Court / Supreme Court: GSTAT is the final fact-finding authority. Subsequent appeals to the High Court under Section 117 lie strictly on substantial questions of law.

Frequently Asked Questions: GSTAT & GST Appellate Litigation
Clear, authoritative guidance on appellate timelines, tribunal jurisdiction, and notice defense in Gujarat.
What is the Goods and Services Tax Appellate Tribunal (GSTAT) in Gujarat?
The Goods and Services Tax Appellate Tribunal (GSTAT) is the statutory second appellate forum established under Section 109 of the CGST Act, 2017. For Gujarat, the State Bench in Ahmedabad and Area Benches have jurisdiction over appeals arising from orders passed by the First Appellate Authority [Commissioner (Appeals)] under Section 107.
GSTAT is the final authority on questions of fact. If an assessee is aggrieved by an order passed by the First Appellate Authority confirming an unjust tax demand, GSTAT is the critical forum where evidence, accounts, and legal contentions are rigorously evaluated.
What is the mandatory pre-deposit required to file an appeal before GSTAT?
Under Section 112(8) of the CGST Act, an appeal cannot be admitted unless the appellant deposits:
- Full amount of tax, interest, fine, and penalty arising from the impugned order as is admitted by him; and
- A sum equal to 20 percent of the remaining amount of tax in dispute (in addition to the 10 percent deposited before the First Appellate Authority), subject to statutory caps.
Under Section 112(9), once this 20% pre-deposit is paid, the recovery proceedings for the remaining 70% balance demand stand automatically stayed until the final disposal of the appeal.
What is the time limit for filing an appeal before GSTAT?
Under Section 112(1), an appeal must be filed within three months from the date on which the order sought to be appealed against is communicated to the person preferring the appeal. For orders that were passed prior to the formal operationalization of GSTAT benches, the statutory limitation period was extended by government notifications (such as Central Tax Circular No. 132/02/2020 and subsequent orders), allowing assessees to file their appeals within three months from the date the President or State Bench enters office.
Can an advocate represent my company during DGGI summons and statements?
Yes. When the Directorate General of GST Intelligence (DGGI) or the Anti-Evasion wing issues summons under Section 70 of the CGST Act, the proceedings are deemed judicial within the meaning of Sections 193 and 228 of the Indian Penal Code (now Bharatiya Nyaya Sanhita). An experienced advocate guides corporate executives on the legal scope of the inquiry, prepares accurate documentary submissions, prevents coercive or involuntary statements, and files necessary representations to ensure due process is followed.
